Club.CUSoon: Booking Terms & Conditions

  1. IMPORTANT
    1. Please read these terms and conditions carefully as all bookings made via the Club.CuSoon Website are made subject to these terms and conditions and the person making the booking will be deemed to have accepted these Terms and Conditions on behalf of all persons who will be staying at the Participating Property under the booking once any payment is made in relation to the booking..
    2. Club.CuSoon Bookings may also be governed by and subject to additional terms and conditions which are applied by individual Participating Properties. These terms and conditions may relate to items such as payments, deposits and cancellations and you should confirm the exact conditions directly with the Participating Property before booking. In the event of any inconsistency between these Terms and Conditions and the terms and conditions applied by a Participating Property, the former will prevail.
  2. Definitions 
    1. In these Terms and Conditions:
    2. "Benefits" means any of the facilities, discounts, services or arrangements offered or available to you as a result of your membership in the Club.CuSoon program.
    3. "Mantra Group" means Samarad Pty Ltd trading as Mantra Group.
    4. “Mantra Group Gift Card” means a gift card bearing the Mantra Group, Peppers®, Mantra® or BreakFree® brand purchased to pay for the accommodation portion of a booking at a Participating Property.
    5. "Participating Properties" means any property associated with Peppers®, Mantra® and BreakFree® Retreats, Resorts, Hotels and Apartments in Australia and New Zealand.
    6. "Password" means your Club CUSooon password.
    7. "Special Offers" means any offers made to Club.CuSoon members which may be redeemed via the Club.CuSoon website.
    8. "You" and "Your" mean the Club.CuSoon member who is making the booking.
    9. "Username" means your Club.CuSoon username.
    10. "Website" means www.clubcusoon.com.au.
  3. Personal Use Only
    1. The purpose of Club.CuSoon is to provide benefits to Club.CuSoon members and as such you may not sell, assign or transfer your membership, bookings made with your membership or any of the Benefits of your membership.
    2. You may not use your membership or any of the Benefits of your membership for commercial benefit and Club.CuSoon Benefits are only available on bookings made for genuine personal use by you and the people staying with you. 
  4. Photographic Identification
    1. When you check-in for a stay booked with your Club.CuSoon membership, you may be asked to provide photographic identification or other evidence to verify that you are the Club.CuSoon member who made the booking. 
    2. If you are unable to provide such evidence your booking may be cancelled and you may be liable to pay Mantra Group an amount equal to the full booking amount plus any other costs incurred by Mantra Group in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to Mantra Group under this term.
    3. If you wish to make a booking for non-personal or commercial use you can make such bookings directly with the property. You cannot make such bookings through the Club.CuSoon Website.
  5. How to Book / Quotes and Reservations
    1. You may only redeem Club.CuSoon Special Offers online via the Club.CuSoon Website and you must provide a valid Club.CuSoon Username and Password when prompted. 
    2. Bookings via the Club.CuSoon Website are subject to the availability and applicable pricing of the relevant Participating Property at the time of the booking and some conditions and/exclusions may apply including but not limited to minimum stay requirements.
  6. Payment
    1. Full payment for your booking must be made at the time of booking.
    2. Payment may be made by Visa, Mastercard, Diners and American Express, Mantra Group Gift Card or POLi internet banking (only available online).  
    3. A 2% surcharge will apply to all credit card and debit card transactions however no surcharge will apply to payments made using POLi internet banking.
    4. Once full payment is received a booking confirmation will be available to view and print off the Club.CuSoon Website or will be forwarded to you by email.
  7. Rates and Charges
    1. Rates quoted on the Club.CUSoon Website are in the relevant Participating Property's local currency and are subject to change at any time until full payment is received. 
    2. Quoted rates are inclusive of GST where applicable.
    3. Quoted rates do not include transport to or from the Participating Property or items of a personal nature such as laundry, telephone, taxis, room service, meals, transfers, existing or proposed taxes (including airport taxes) or government charges, unless otherwise indicated.
    4. If you have been quoted a rate that includes meals and or transport you should contact the relevant Participating Property directly to obtain details of these inclusions.
  8. Amendments
    1. To the extent permitted by law Club.CuSoon bookings once confirmed cannot be amended.  
    2. Amendments will be deemed a cancellation and you will be charged a 100% cancellation fee.
  9. Cancellation
    1. To the extent permitted by law all Club.CuSoon bookings are non-refundable and a 100% cancellation fee applies to all bookings once they have been processed via the Club.CuSoon website.
  10. No-Shows or Terminations
    1. If you do not show up for your booking or terminate your booking early after you have checked in you will be charged a 100% cancellation fee and will forfeit the full amount of your booking fee to Mantra Group.
    2. If you wish to terminate your stay early because you are dissatisfied with some aspect of your stay clause 10.1 will apply however property management may in its absolute discretion provide you with refund for an amount equal to part or all of the monies paid by you in relation to the booking. 
    3. If property management does elect to pay a full or a part refund, such refunds will be made via cheque, direct deposit, or credit card and credit card refunds will only be processed back to the credit card that was used to pay for the booking.
    4. Refund processing may take up to ten (10) business days.
  11. Check-in
    1. Standard check in time is 2:00pm but times may vary for particular Participating Properties and you should confirm the check-in time with the relevant Participating Property prior to your scheduled check-in day. 
    2. If you wish to guarantee your ability to check-in prior to 2:00pm you must book an additional nights stay and pay the applicable rate for that additional night.
  12. Check out
    1. General guest standard check-out time is 10:00am however standard check-out time for Club.CuSoon members who book via the Club.CuSoon Website using their Club.CuSoon Username and Password is 11:00am. 
    2. Club.CuSoon members may also request a later check-out time of 12 noon. 
    3. Requests for 12 noon check-out should be made direct with the relevant Participating Property and may be approved by that property in its absolute discretion. 
    4. If a 12 noon check-out is approved it will be provided to you at no extra charge.
  13. Late check-out
    1. If you wish to check-out later than the standard Club.CuSoon check-out time you must obtain approval from property management at least 12 hours prior to your scheduled check-out time.
    2. Property management may approve a request for late check-out in their absolute discretion. 
    3. If you check-out of a non-capital city property after 11:00am (or 12 noon if you have had a later check-out approved) the following additional charges will be applied to your account and will be payable by you on check-out:
      1. (a) a  surcharge of $20.00 per hour for every hour after 11:00am (or 12:00 noon if applicable) that you fail to check-out; or 
      2. (b) if you check-out after 2pm a charge equivalent to the fully daily rate which applies to your booking. 
      3. (c) If you check-out of a capital city property after 11:00am (or 12 noon if you have had a later check-out approved) the following additional charges will be applied to your account and will be payable by you on check-out:
      4. (d) if you check-out before 1:00pm a  surcharge of $60.00; 
      5. (e) if you check-out between 1:00pm and 2:00pm a surcharge of $100.00; or
      6. (f) if you check-out after 2pm a charge equivalent to the fully daily rate which applies to your booking. 
  14. Security Deposits
    1. You must provide a credit card authorisation or imprint when you check-in. 
    2. This authorisation may be used to cover incidental items including but not limited to telephone charges, security bond or deposit for any breakages or damage incurred during your stay or cleaning charges in excess of the normal level of cleaning.
    3. The pre-authorisation process validates your credit card, and protects both the cardholder and merchant from increasing fraud incidents.  
    4. The pre-authorised amount is set aside by the card issuer for a period of up to 14 days from the date of pre-authorisation and the pre-authorisation will affect your available funds balance or spending limit.  For more information on this practice please contact your card issuer.  
    5. Once a pre-authorisation has been made, Mantra Group cannot release, remove or lower the authorised amount, until we process the final account on departure.  This is a restriction imposed by the card issuer, and cannot be negotiated.
    6. Where a credit card is not available a minimum $200.00 cash deposit will be required on check-in.  (The actual amount required may be higher at some Participating Properties.)
  15. Room Allocation
    1. In the unlikely event that Mantra Group cannot provide accommodation at the Participating Property for which you have booked, Mantra Group will at no additional expense to you relocate you into an alternative property which in the reasonable opinion of Mantra Group is of comparable quality and in a comparable location. 
    2. If a property of comparable quality in a comparable location is not available, Mantra Group may relocate you to a property of less comparable quality or less comparable location in which case Mantra Group will pay you an amount which it reasonably believes represents the difference between the rate payable for the alternate property and the rate paid by you for the Participating Property at which you had booked.
    3. Should you wish to be relocated to an alternative property other than the property chosen by Mantra Group under this term, you will be required to pay any difference in price between the Mantra Group's choice of property and your chosen property.
  16. Hotel and Apartment Servicing
    1. Club.CuSoon bookings do not include room servicing unless otherwise stated, however a 'Refresh' service is available for separate purchase at the Participating Property.
    2. You can inquire about this 'Refresh' service when you check-in to the Participating Property.

  17. Kids Club
    1. Additional charges will apply if you wish to use any Kids Club services and you may obtain information on Kids Club services and charges by contacting the relevant Participating Property direct.  
    2. As a general guide:
      1. (a) if a child requires one on one care, adequate notice (at least 48 hours) is required and an extra fee may be involved; 
      2. (b) Kids Club will only be available to children checked into a property where a Kids Club is located, and during Queensland and New South Wales school holiday periods;
      3. (c) Kids Clubs do not operate at any Peppers Retreats;
      4. (d) Age restrictions apply to most Kids Clubs; and 
      5. (e) a minimum of four children are usually required to operate a Kids Club and Mantra Group and/or a Participating Property reserve the right at any time to refuse service if adequate care cannot be provided, or if minimum numbers are not reached. 
  18. Children's Prices
    1. In most cases, children's prices for accommodation refer to children occupying the same room/unit with at least two adults and using existing bedding.  
    2. Additional charges will apply if extra beds or linen (including rollaways, sofa beds or cots) are required.

  19. Facilities and Services
    1. Whilst care is taken to ensure that the description of facilities and services of the Mantra Group is accurate, these are continually being changed, upgraded, and on occasion taken out of service. 
    2. If any feature/facility is essential to you in choosing a particular property, it is your responsibility to confirm with the property that the feature/facility is available before making a booking. 
    3. Mantra Group is not liable for omissions, errors or changes to the facilities and services at a property, whether temporary or permanent.
    4. Accommodation facilities listed may not apply to all room types.
  20. Website Information
    1. Mantra Group makes its best efforts to ensure that the information available on the Club.CuSoon Website is correct however Mantra Group cannot and do not guarantee that the Club.CuSoon Website is free from errors or faults. 
    2. If any feature/facility is essential to you in choosing a particular property, it is your responsibility to confirm with the property that the feature/facility is available before making a booking.
    3. Mantra Group does not accept liability for any errors or omissions and reserves the right to change information published on the Club.CuSoon Website at any time. 
    4. Mantra Group does not accept liability for any loss arising out of the use of or connected with the Club.CuSoon Website or for any products or services purchased from the Club.CuSoon Website.
  21. Special Requests
    1. Whilst Mantra Group attempts to satisfy all special requests, Mantra Group does not guarantee that special requests can be accommodated.
  22. Maps and Images
    1. Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided.  
    2. Destination shots may have been supplied to Mantra Group by third parties and Mantra Group does not guarantee the accuracy of any destination shots.  
    3. Photos are indicative only. 
  23. Travel Insurance
    1. Mantra Group strongly recommends that at the time of booking you purchase comprehensive travel insurance to cover items including but not limited to: loss of booking amount through cancellation, loss or damage to personal baggage, loss of money and medical expenses.
  24. Gift Cards
    1. Mantra Group Gift Cards can be used as a form of payment for Club.CuSoon bookings.  The value of the Mantra Group Gift Card must exceed the cost of the booking as full payment is required at the time of booking for all Club.CuSoon bookings.
  25. Unaccompanied minors
    1. All guests under the age of 18 must be accompanied by a parent/guardian over the age of 18.  
    2. Mantra Group reserves the right to refuse or cancel any booking made by an unaccompanied minor and the full booking amount will be forfeited to Mantra Group for any breach of this condition.
  26. Third Party Products and Services
    1. Mantra Group sometimes includes third party products or services in special packages and Mantra Group is not liable under any circumstances for any failure by third party providers to provide products or services, nor for any error, alteration or change of any kind made by those third party providers following acceptance of a booking by them. 
    2. All third party coupons, vouchers, receipts and tickets are issued subject to the terms and conditions specified by those third parties. 
    3. Mantra Group does not warrant the accuracy of any information, statements or representations made by third parties,
    4. Mantra Group is not liable for any act, omission, default or negligence of any third party provider.
  27. Release and Indemnity
    1. To the extent permitted by the law, you agree to release and hold harmless, Mantra Group and its current and former officers, employees and agents against and from all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses,  property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your Club.CuSoon booking or your stay at the relevant Participating Property even if caused or contributed to by Mantra Group's negligence, breach of duty or otherwise.
    2. You agree to indemnify Mantra Group and its current and former officers, employees and agents for all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) incurred or suffered by Mantra Group or its current or formers officers, employees or agents arising out of, caused by, attributable to or resulting from your Club.CuSoon booking or stay at the relevant Participating Property except to the extent  caused or contributed to by Mantra Group's or its current or former officer's, employee's or agent's negligence.

  28. Events beyond control
    1. Mantra Group is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.
    2. All travel documents, observance of laws and government regulations are your responsibility.

  29. Passwords
    1. You must not share your Username or Password with any other person without Mantra Group's prior written permission.
    2. You are responsible for all use of your Username and Password and must notify Mantra Group immediately if you become aware or have reasonable grounds to believe that your Username or Password has been compromised.
  30. Use of Information 
    1. You consent and authorise Mantra Group and the relevant Participating Property to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
    2. You consent to information which you have provided to Mantra Group or the relevant Participating Property as part of your booking being used by Mantra Group, the relevant Participating Property or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate to the Club.CuSoon Program, Mantra Group, Mantra Group's related bodies corporate or Participating Properties.
    3. Upon request by you and to the extent permitted or required by law, Mantra Group will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.
  31. General
    1. The Terms and Conditions are governed by and will be construed in accordance with the laws of the State of Queensland, Australia.
    2. Nothing in these Terms and Conditions affects any rights you may have and which by law cannot be excluded, including under the Competition and Consumer Act 2010 (Cth) and under State and Territory consumer protection legislation.
    3. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
