Club.CUSoon: Membership Terms & Conditions

1.1Your use of and participation in the Program is governed by these Terms and Conditions and you are bound by these Terms and Conditions. 

1.2These Terms and Conditions may be amended by Mantra Group from time to time and the Terms & Conditions which apply at any given time are the Terms and Conditions which are published on the Club.CUSoon Website.

 

2.1In these Terms and Conditions:

(a)“Benefits” means any of the facilities, discounts, services or arrangements offered or available to you as a result of your membership in the Program;

(b) “Mantra Group” means Samarad Pty Ltd trading as Mantra Group;

(c)“Participating Properties” means any property associated with Peppers®, Mantra® and BreakFree® Retreats, Resorts, Hotels and Apartments in Australia and New Zealand;

(d)“Participating Website” means any of the following websites: www.mghotels.com.au, www.peppers.com.au, www.peppers.co.nz, www.mantra.com.au, www.breakfree.com.au

(e)“Password” means the password nominated by you when you become a member of the Program;

(f)“Program” means the Club.CUSoon program;

(g) “You” and “Your” mean the person who is a member of the Program;

(h)“Username” means the username nominated by you when you become a member of the Program; and

(i)“Club.CUSoon Website” means www.clubcusoon.com.au.

 

3.1Participation in the Program is only open to individuals for personal use and is not open to families, groups, companies, trusts, partnerships or other entities.

3.2Mantra Group reserves the right to accept or reject any application for membership or to cancel any membership once granted.

3.3Once Mantra Group has accepted your application for membership you will be able to nominate a unique Username and Password.

3.4The contact details you provide when applying for membership in the Program will be used by Mantra Group to administer your participation in the Program and you must notify Mantra Group as soon as practicable if your contact details change.

 

4.1You may not sell, assign or transfer your membership or any of the Benefits.

4.2You may not use your membership or any of the Benefits for commercial gain.

4.3You may not redeem any of the Benefits in conjunction with any other Mantra Group, Participating Property or third party offer or benefit.

 

5.1Subject to this clause 5 and you complying with these Terms and Conditions, as a member of the Program you are entitled to the following:

(a)a 5% discount on bookings at Participating Properties (excluding Peppers Anchorage, Peppers Convent, Peppers The Sands Resort Torquay and Q1 Resort & Spa) when booked online via a Participating Website;

(b)access to member only offers via the Club.CUSoon Website

(c)a guaranteed late checkout of 11:00am for all stays at Participating Properties; and

(d)the right to request a later checkout of 12:00noon for any stay at a Participating Property which that Participating Property may approve in its absolute discretion.

5.2The Benefits referred to in clause 5.1 will only be available on bookings which satisfy the following conditions:

(a)bookings must be made online via the Club.CUSoon Website or a Participating Website;

(b)you must provide a valid Username and Password at the time of booking; and

(c)no other offer by Mantra Group, a Participating Property or a third party may be redeemed in connection with the booking.

5.3To avoid doubt, none of the Benefits referred to in clause 5.1 can be redeemed on bookings which have been made through any channel other than the Club.CUSoon Website or a Participating Website.

 

6.1Bookings are made subject to availability at the relevant Participating Property.

6.2Bookings made via the Club.CUSoon Website or a Participating Website are subject to the booking terms and conditions published on that website and if there is any inconsistency between those terms and conditions and these Terms and Condition, the former will prevail.

6.3Some conditions and/exclusions may apply on individual bookings at particular Participating Properties including but not limited to minimum stay requirements and blackout periods.

 

7.1The Program or any Benefit may be varied or withdrawn by Mantra Group at anytime.

7.2Mantra Group will use reasonable endeavours to provide you with 30 days notice of any material change to the Program or the Benefits.

7.3Notice will be provided to you at the email address which you provide to Mantra Group when you join the Program or at any other email address you provide to Mantra Group pursuant to clause 3.4.

 

8.1Mantra Group gives no warranty as to the continuing availability of the Program. 

8.2Subject to any rights that cannot be excluded by law, any misuse of the Program or breach by you of the Terms and Conditions may result in the immediate cancellation or suspension of your membership and your access to the Benefits.

 

9.1To the extent permitted by the law, you agree to release and hold harmless, Mantra Group and its current and former officers, employees and agents against and from all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses,  property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from these terms and conditions or your participation in the Program even if caused or contributed to by Mantra Group’s negligence, breach of duty or otherwise.

 

10.1You agree to indemnify Mantra Group and its current and former officers, employees and agents for all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) incurred or suffered by Mantra Group or its current or formers officers, employees or agents arising out of, caused by, attributable to or resulting from these terms and conditions or your participation in the Program except to the extent  caused or contributed to by Mantra Group’s or its current or former officer’s, employee’s or agent’s negligence.

 

11.1You consent and authorise Mantra Group to collect, use and disclose your personal information for the purposes of providing Benefits to you or otherwise administering your participation in the Program.

11.2You consent to information which you have provided to Mantra Group as part of your membership in the Program being used by Mantra Group or any of its related bodies corporate for the purpose of informing you about offers and promotions which relate to the Program, Mantra Group, Mantra Group’s related bodies corporate or Participating Properties.

11.3Upon request by you and to the extent permitted or required by law, Mantra Group will provide you with access to and/or the ability to correct your personal information however only the person named as the member will be entitled to access and/or correct that person’s personal information.

 

12.1The Terms and Conditions and membership in Program are governed by and will be construed in accordance with the laws of the State of Queensland, Australia.

12.2Nothing in these Terms and Conditions affects any rights you may have and which by law cannot be excluded, including under the Competition and Consumer Act 2010 (Cth) and under State and Territory consumer protection legislation.

12.3If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
